Exemptions are the only mechanisms to stop 40B,  Without them, the developer gets a comprehensive permit.   This bypasses the Local Board Oversight and the Local Zoning By-Laws that other Developers have to abide by.

10% Housing Exemption:

10% of your the town's housing stock is approved Subsidized Housing Inventory (SHI) the town does not have to accept a 40B Plan.  We do not meet this criteria

Our current rate:            8.6%

2006                               8.4%

2003-2005 (?)                7.6%

2002                              6.48%

1.5% Land Use Exemption:

1.5% of your usable land (with exemptions-see below) is used by SHI housing.

 

Exempted properties are removed from the usable land calculation:  

Water Bodies

Flood Plain (where no housing is allowed)

Conservation Restricted land (where no housing is allowed)

Town, State (or Division of) and US Government Owned Land

We do not know if we meet this criteria.  But almost half our land is Conservation Restricted or owned by Town, State (or Division of) and US Government Owned Land.

It has been strongly suggested that Ipswich undertakes this study.
